Can a U.S. expat living abroad use ACA insurance to cover a $400,000+ cancer surgery?

I'm a 50+ year-old U.S. citizen living in Portugal with a cancer diagnosis that requires CRS+HIPEC surgery — one of the most complex abdominal procedures performed anywhere. At a major academic cancer center in the United States, the uninsured cost runs $200,000–$400,000+.

Why New York — Not North Carolina

Both states have ACA Marketplace plans and major CRS+HIPEC surgical centers. But New York is dramatically better for one specific legal reason.

No Denial for Pre-Existing Conditions
Under the federal ACA and New York State law, no insurer can deny coverage, exclude treatment, or charge higher premiums based on a pre-existing condition — including active cancer. No medical underwriting. No waiting period. No exclusion period for cancer treatment. I enroll, I pay premiums, coverage begins.

One important note: this protection applies to ACA Marketplace plans only. Private international expat insurance — Cigna Global, GeoBlue, Allianz — operates under medical underwriting and will almost certainly exclude active cancer as a pre-existing condition. ACA Marketplace is the only realistic path for coverage of a planned cancer surgery in the U.S.

The True Cost of CRS+HIPEC — With and Without Insurance

CRS+HIPEC is one of the most complex abdominal surgeries performed. At major academic cancer centers, the billed charges break down like this:

ACA Plan Tiers — Which One to Choose

ACA plans come in four metal tiers. All four share the same $10,600 OOP maximum in 2026. The difference is how quickly I hit it and what I pay monthly.

Gold is the recommended tier
With a surgery billing $200,000+, I will hit the $10,600 OOP maximum within days regardless of which tier I choose. The deductible only affects how much I pay before insurance kicks in — and you'll blow past any deductible immediately on a surgery of this magnitude. Platinum has near-zero deductibles but costs $150–$300/month more in premiums than Gold. Same $10,600 cap either way, so the lower Gold premium wins on total annual cost.

One exception: if a specific Platinum plan covers your surgeon at MSK and the equivalent Gold plan does not, network coverage takes priority over premium savings.

Critical Step Before Enrolling
Before finalizing any plan, call the insurer directly with your MSK surgeon's NPI (National Provider Identifier) number and confirm:

Choose a PPO plan, not an HMO. PPOs allow out-of-network access as a fallback. HMOs restrict you to in-network only — if your surgeon isn't in-network, you're fully exposed.

Establishing New York Residency

To enroll in New York's ACA Marketplace, you must be a New York State resident. The ACA defines residency as the state where you live with the intent to remain.

What qualifies: physical presence in New York, intent to reside demonstrated by a signed lease. No minimum prior duration of residence is required before enrolling.

What does not qualify: a P.O. box, a mailbox service, or an address used solely to obtain insurance without genuine physical presence.

The Compliance Path
Genuinely relocate to New York. Sign a 6–12 month lease. CRS+HIPEC surgery requires 10–21 days of hospitalization followed by months of recovery — I will genuinely be living there throughout this period. This is a legitimate relocation to access specialized care.

Key Warnings

  1. Verify network before enrolling. MSK is not in every plan's network. Confirm surgeon and hospital NPI with the insurer before paying your first premium. This is the single most important action item.
  2. Premium estimates are approximate. Exact monthly premium depends on your specific county in New York and which insurer you select. Always run the actual quote at nystateofhealth.ny.gov for your zip code.
  3. Tax advisor is essential before enrolling. FEIE treatment of foreign income could qualify you for NY Medicaid instead of Marketplace coverage — which would reduce total cost dramatically. Do not estimate your own income bracket.
  4. Hospital charity care runs in parallel. MSK and most major academic centers have financial assistance programs based on income. Apply regardless of insurance status. They do not conflict with ACA coverage and can reduce the OOP portion further.
  5. International expat insurance will not work. Private international health insurers use medical underwriting. Active cancer is almost universally excluded as a pre-existing condition. ACA Marketplace is the only viable path.
